Safety terms, product use limitations, legal compliance, customer responsibility, and liability limitations.
This policy explains safety-related responsibilities, intended product use, legal compliance, inspection requirements, assumption of risk, and liability limitations related to products sold, supplied, or installed by GT Factory LLC.
1. General Safety Notice
Products sold, supplied, or installed by GT Factory LLC may affect vehicle operation, handling, ride height, drivability, emissions, noise, lighting, safety systems, or other vehicle characteristics. Certain products may be intended for off-road, track, show, or other limited-use applications only.
The customer is responsible for understanding the intended use of the product and for ensuring that the vehicle remains safe and suitable for its actual use after installation.
2. Intended Use and Legal Compliance
GT Factory LLC does not guarantee that any product or service is legal for use on public roads or compliant with emissions, noise, lighting, inspection, smog, or other requirements in every jurisdiction. The customer is responsible for independently verifying the legality of the purchase, installation, and use of any product or service in the jurisdiction where the vehicle will be operated before placing the order or proceeding with the work.
If the customer knowingly orders a product or service for off-road, track, show, or other limited use, or otherwise accepts the risk that it may not comply with the requirements of a particular jurisdiction, that does not create any basis for a warranty claim, complimentary removal, return, rework, or other no-charge obligation on the part of GT Factory LLC unless expressly confirmed in writing.
3. Installation, Inspection, and Follow-Up Procedures
Where installation or related work is performed by GT Factory LLC, such work is performed within the agreed scope of work and in accordance with the professional judgment of GT Factory LLC. If a product is installed, modified, or serviced by anyone other than GT Factory LLC, the customer is responsible for selecting a qualified provider and for the quality of such work.
Depending on the nature of the installed components or work performed, the vehicle may require additional inspection, diagnostics, calibration, adjustment, alignment, adaptation, or follow-up inspection. The customer is responsible for ensuring that such procedures are completed where necessary for the safe and proper operation of the vehicle.
4. Customer Responsibility After Installation
After installation, the customer is responsible for operating the vehicle with due regard to the nature of the work performed and the components installed, and for promptly responding to any signs of malfunction, abnormal vehicle behavior, warning messages, leaks, unusual noises, vibrations, or other potentially unsafe conditions.
If continued operation may worsen the condition or affect safety, the customer must stop using the vehicle until proper inspection has been performed.
5. No Guarantee of OEM Warranty, Compliance, or Inspection Outcome
GT Factory LLC does not guarantee the preservation of any manufacturer, dealer, or OEM warranty following the installation of aftermarket parts, modifications, or related work. GT Factory LLC also does not guarantee that the vehicle will pass inspection, smog inspection, dealer review, warranty review, or any other evaluation process after such components are installed or such work is performed.
Any decision to provide, limit, or deny manufacturer, dealer, warranty, or other coverage, or to determine whether the vehicle complies with the requirements of a particular jurisdiction or inspection process, is made by the applicable party and is outside the control of GT Factory LLC.
6. Assumption of Risk
By ordering, purchasing, or installing aftermarket parts, modifications, or related services, the customer understands and accepts that such components and work may affect vehicle characteristics, operating conditions, maintenance requirements, the compliance of certain systems with applicable legal requirements, and the outcome of later inspections or reviews.
The customer assumes the risks associated with the use of such products and services to the extent those risks are obvious, reasonably foreseeable, or inherent in the nature of the requested components or work.
7. Limitation of Liability
To the fullest extent permitted by law, GT Factory LLC shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of vehicle use, downtime, towing, substitute transportation, lost time, lost profits, or other related expenses arising out of the use of any product, the performance of any work, or the inability to use the vehicle.
Any liability of GT Factory LLC, if established, shall in all cases be limited to the amount actually paid by the customer for the specific product or service giving rise to the claim, unless otherwise required by applicable law.
